Terms & conditions
These terms apply when you book a journey with Wai Wellness Journeys (“we”, “us”). Please read them before you pay a deposit: paying the deposit means you accept them on behalf of everyone in your booking. If anything is unclear, write to us at info@waijourneys.com before you book.
1. What we do
We plan and arrange wellness journeys from our base on Koh Yao Noi, Thailand. Your accommodation, Muay Thai and yoga classes, meals, transfers and other extras are provided by independent local partners (for example the bungalow, the gym and the yoga teachers). We choose them with care and coordinate your stay, but they run their own businesses, premises and sessions under their own rules.
2. Booking
- Sending a booking request through our website, email or WhatsApp is free and doesn't commit you to anything.
- We check availability and reply by email with your confirmed dates, journey, extras, total price and deposit amount.
- Your booking is confirmed only when you have paid the deposit and we have confirmed receipt by email.
- The person who books confirms they are at least 18 years old and accepts these terms for everyone in their booking.
3. Prices and payment
- Prices are per person, in euros (EUR), and include what is listed for your journey on our website and in your confirmation.
- Flights, airport and ferry transfers (unless booked as an extra), travel insurance, visas, personal expenses and anything not listed are not included.
- Deposit: we email you a secure card payment link. The deposit amount is stated in your confirmation email.
- Balance: you pay the rest when you arrive on the island, in cash, or by card with a 6% card processing fee.
- Items marked “on request” are priced separately once we confirm them.
4. Changes and cancellations
- If you need to cancel or change your dates, tell us by email as early as possible. The cancellation and refund terms that apply to your booking are set out in your confirmation email.
- Leaving early or missing sessions: unused nights, classes, meals or extras are not refunded.
- If we have to change something, such as a class time, a teacher or your bungalow, we will offer you an alternative of similar standard.
- If we have to cancel your journey before it starts for reasons within our control, we will refund what you have paid us in full.
5. Health, fitness and your declaration
- Our journeys are open to beginners, but Muay Thai, yoga and island activities are physical. Before you book, check with your doctor that you are fit to take part, especially if you are pregnant, injured, recovering from surgery or have a heart, blood pressure, breathing, joint, back or other medical condition.
- You agree to tell us, and the coach or teacher, about any injury, condition, medication, allergy or pregnancy that could affect your safety, before the first session and whenever it changes. We may ask you to fill in a short health form before you start.
- You confirm that the information you give us about your health is true and complete. We and our partners rely on it, and we are not responsible for consequences of information you did not give us or that was incorrect.
- A coach or teacher may adjust, pause or stop your participation if they believe you or others are at risk. You can always stop, rest or skip an exercise, and you agree to stop and tell the coach if you feel pain, dizziness or discomfort.
- We do not provide medical, therapeutic, psychological or diagnostic services, and nothing in our journeys is a treatment. No coach, teacher or member of our team gives medical advice.
6. Participation at your own risk (assumption of risk and release)
Please read this section carefully. By booking and taking part, you confirm that you understand and accept the following:
- Muay Thai is a martial art and a contact sport. Even in beginner, technique-focused classes there is a risk of injury, including sprains, strains, bruises, cuts, broken bones, dental injuries, concussion and, rarely, more serious injuries.
- Yoga, stretching and fitness training can cause muscle, joint or back injuries, especially if you go beyond your limits.
- The island environment carries its own risks: heat and sun, dehydration, slippery or uneven paths, insects, animals (including dogs and monkeys), tropical illness, limited medical facilities on Koh Yao Noi and longer travel times to a hospital.
- You take part in every session and activity voluntarily, at your own pace and at your own risk. Sparring is always optional.
- To the fullest extent permitted by law, you release Wai Wellness Journeys, its owners, staff and representatives from claims for injury, illness, loss or damage arising from these normal and inherent risks, unless they were caused by our own negligence.
- Before your first session, we or our partner may ask you to sign a participation and liability waiver. Taking part may depend on signing it.
7. Training rules
- Follow the instructions of coaches, teachers and staff, and respect the rules of each gym or studio.
- Use the protective equipment you are given or asked to bring (for example hand wraps, gloves, shin guards and a mouth guard when needed).
- Warm up, drink water and tell the coach about any pain or problem straight away.
- Never train, ride or take part in any activity under the influence of alcohol, drugs or medication that affects your judgement or balance.
8. Scooters, motorbikes and other vehicles
Road accidents are one of the biggest risks for visitors in Thailand. If you rent or ride a scooter or motorbike, including one we help you book:
- You must hold a valid motorcycle driving licence that is accepted in Thailand (usually a licence from your home country with the motorcycle category plus an International Driving Permit, or a Thai licence). Without one, you may be fined by the police and your travel insurance may not cover you.
- You must always wear a helmet, ride sober, follow Thai traffic law and ride carefully on roads that can be narrow, unlit, sandy or wet.
- The rental agreement is between you and the rental provider. You are responsible for checking the vehicle before riding, for the deposit or passport arrangements the provider asks for, and for any damage, theft, fines or costs.
- You ride entirely at your own risk. To the fullest extent permitted by law, we are not responsible for any accident, injury, death, damage, loss, fine or legal consequence related to riding or renting a vehicle.
- The same applies to bicycles, cars and any other vehicle you drive yourself.
9. Sea, swimming, boats and excursions
- Beaches on Koh Yao Noi usually have no lifeguards. Tides, currents, rocks, jellyfish and sea urchins can be dangerous. Swim only where it is safe, never alone and never after drinking alcohol.
- Boats, longtail boats, ferries, kayaks, snorkelling and island trips are run by independent operators under their own conditions. Wear the life jacket offered and follow the crew's instructions.
- Optional excursions and free-time activities you arrange yourself are not part of our services and are at your own risk.
10. Food, allergies and drinking water
- Meals are traditional Thai food prepared by local partners. Tell us about allergies, intolerances and dietary needs when you book. We will pass them on and our partners will try to meet them, but we cannot guarantee that any meal is free from allergens or traces of them.
- Drink bottled or filtered water. You are responsible for food and drink you buy yourself outside the journey.
11. Travel insurance
Travel insurance is a condition of booking. You must have valid travel insurance for your whole stay that covers medical treatment, hospital care and emergency evacuation or repatriation, and that covers the activities you will do, including Muay Thai and other sports and, if you will ride one, scooters or motorbikes. We strongly recommend that it also covers cancellation, lost belongings and personal liability. We may ask to see proof of insurance before your first session, and we may refuse participation without it.
12. Medical emergencies and costs
- In an emergency we will help you get to the nearest clinic or hospital. You authorise us and our partners to arrange first aid, medical help and transport for you if you cannot decide for yourself.
- All costs of medical treatment, medicines, hospital stays, transport, evacuation and repatriation are your responsibility (or your insurer's), even if we helped arrange them.
- Please share an emergency contact with us before you arrive.
13. Belongings, money and valuables
You are responsible for your belongings, passport, cash, phone and valuables at all times, including at the gym, the beach, in transport and in your accommodation. Please use the safe storage your accommodation offers. To the fullest extent permitted by law, we are not responsible for theft, loss or damage of your belongings.
14. Independent partners and third parties
Accommodation, gyms, yoga teachers, restaurants, transport, boat operators, rental shops, temples and other providers are independent businesses and are responsible for their own services, premises, staff and equipment. We are not liable for their acts or omissions, but if something goes wrong, tell us and we will help you raise it with them.
15. Our responsibility and its limits
- We will arrange your journey with reasonable skill and care.
- To the fullest extent permitted by law, we are not responsible for injury, illness, death, loss or damage that results from: your own actions, choices or failure to follow instructions or these terms; health information you did not give us; the normal risks of the activities you choose; the acts or omissions of independent partners and third parties; or events outside our control (see section 18).
- We are not responsible for indirect or consequential losses, such as missed flights, lost earnings, lost holidays or disappointment.
- To the fullest extent permitted by law, our total liability to you for anything related to your booking is limited to the total amount you paid us for that booking.
- Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by our own negligence, or for fraud.
16. Your responsibilities and indemnity
- Your passport, visa, vaccinations, health checks and entry requirements are your responsibility. Any information we share about them is general guidance, not legal advice.
- Please respect local people, partners, other guests, the island, Thai law and local customs, including temple etiquette and the dress code.
- Illegal drugs are strictly prohibited and Thai drug laws are severe. We or our partners may end your participation and stay, without refund, if your behaviour is illegal, puts others at risk or seriously disturbs them.
- You are responsible for any damage you cause to accommodation, equipment, vehicles or property.
- You agree to cover (indemnify) us for any claims, costs, fines or damages that we have to pay because of your breach of these terms, your behaviour or your unlawful acts.
17. Guests under 18
Guests under 18 can only join with a parent or legal guardian who books for them, stays with them for the whole journey, supervises them at all times and accepts these terms on their behalf.
18. Events outside our control
We are not responsible for delays, changes or cancellations caused by events outside our reasonable control, such as severe weather, monsoon storms, natural disasters, epidemics, government action, political unrest, strikes, transport disruption, power or internet outages, or the closure of a partner's venue. If this happens, we will do our best to offer an alternative.
19. Photos and privacy
We will never use photos or videos of you in our marketing without your clear permission, and you can withdraw it at any time. Please respect other guests' privacy too and ask before you photograph or film them. How we handle your personal data is explained in our Privacy & data security policy.
20. Complaints
If something isn't right during your stay, tell us straight away so we can try to fix it on the spot. If you are still unhappy, email us within 30 days after your journey ends and we will reply as quickly as we can.
21. General
- We may update these terms. The version that applies to your booking is the one published on the date you paid your deposit.
- If any part of these terms is found invalid or unenforceable, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- These terms are governed by the laws of Thailand. If you are a consumer living elsewhere, you keep any mandatory rights the law of your country gives you.
